Please read our Terms of Service ("Terms") carefully before using our ("Tamilzo", "us", "we", "our") website or mobile apps ("Platform" or "Services"). Your access to the Platform is predicated upon your agreement and compliance with these Terms together with our Privacy Policy.

These Terms govern your access to and use of the Platform, and any information, text, links, photos, videos, graphics, audio, or other material uploaded to and appearing on the Platform (collectively referred to as "Content"). By using the Platform, you agree to these Terms, and understand that these Terms do in fact form a legally binding contract between you and Tamilzo.

If you do not agree to these Terms, you must immediately stop using the Platform.

1. Acceptance and Eligibility

1.1 Acceptance of Terms

By even merely using/accessing the Platform, You shall be contracting with Tamilzo and You signify Your acceptance to these Terms and other Tamilzo policies (including but not limited to the cancellation & refund terms and published Privacy Policy) as posted on the Platform and amended from time to time, which takes effect on the date on which You use the Platform and thereby create a legally binding agreement to abide by the same.

1.2 Eligibility Requirements

You may use the Platform only if you:

• Are at least 18 years of age
• Have the legal capacity to enter into a binding contract under applicable law
• Are not barred from using the Platform under Indian law or any other applicable jurisdiction
• Provide accurate, current, and complete information during registration

1.3 Modifications to Terms

Tamilzo retains an unconditional right to modify or amend these Terms. You can determine when these Terms were last modified by referring to the "Last Updated" legend above. You can access the latest version of these Terms at any given time on the Platform. Your continued use of and access to the Platform shall be Your consent to such changes. In the event the modified Terms are not acceptable to You, You should discontinue accessing the Platform.

2. Our Services

2.1 Platform Description

Tamilzo enables transactions on the Platform between participating sellers and service providers ("Seller(s)") and Users. Users can order groceries, household items, and related products ("Products") offered for sale by these Sellers in select serviceable areas across India, with delivery typically within 10 minutes, subject to availability and operational conditions.

2.2 Service Availability

The Platform is provided to you on an "AS IS" and "AS AVAILABLE" basis. While we attempt to provide good Services, we make no warranty or representation and disclaim all responsibility and liability for:

• The completeness, accuracy, availability, security, timeliness, or reliability of the Content or Services
• Any harm to your device, loss of data, or other harm that results from your access to and use of the Services
• Any Content or Services that function with error, interruption, delay, disruption, or other imperfection
• The deletion of, or failure to store or transmit, any Content or other communication maintained by the Services

2.3 Intermediary Status

We act as an intermediary between you and product suppliers/retailers. Product availability, quality, and descriptions are subject to supplier accuracy. We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

3. Account Registration and Security

3.1 Account Creation

In order to use some of the Services, you may need to create an account. When you create an account, you agree to provide accurate and complete information and to maintain and promptly update your account information.

3.2 Account Security

You are responsible for safeguarding your account, and any activity that occurs on or through it. We recommend using a strong password that you have not used on other sites previously, and limiting access to your account to better secure it. You will be responsible for the confidentiality of the Account information provided and fully responsible for all activities that take place on Your Account. You agree to immediately notify us of any unauthorized access of Your Account.

3.3 Account Suspension

Tamilzo reserves the express right to refuse access to the Platform at any time without notice for Your failure to abide by the Terms as set forth herein or to comply with applicable laws. We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Orders and Payment

4.1 Order Placement

When you place an order through the Platform, you make an offer to purchase Products. We reserve the right to accept or reject any order at our sole discretion. An order is considered accepted only when we confirm dispatch or delivery.

4.2 Payment Methods

The information relating to the accepted payment methods on the Platform shall be displayed during the purchasing process. All payments must be made through our approved payment methods. Payment processing is handled by third-party payment gateways. We do not store complete payment card details on our servers.

4.3 Payment Failures

Tamilzo is not liable for any payments that do not complete a transaction due to reasons including but not limited to:

• Insufficient funds in Your bank account
• You have not provided correct Payment Details
• Technical issues or interruptions in the Platform or payment processing systems
• Violation of any terms or conditions governing the use of Your Payment Details
• Fraudulent activity or unauthorized use of Your Payment Details
• Your payment card has expired
• Any other circumstances beyond Tamilzo's reasonable control which prevent the execution of the transaction

4.4 Order Rejection or Cancellation

We may reject or cancel orders due to:

• Pricing or product description errors
• Product unavailability or insufficient inventory
• Payment authorization failure
• Suspected fraudulent activity
• Delivery location restrictions or operational constraints

5. Pricing and Fees

All prices displayed on the Platform are in Indian Rupees (INR) and are subject to change without prior notice. Prices shown at the time of order placement will be applicable. Additional charges may apply for delivery, service fees, or packaging. Applicable taxes will be added to your order total.

We reserve the right to correct pricing errors even after order placement. In case of pricing errors, we will notify you and give you the option to proceed at the correct price or cancel the order.

Title of any Products purchased by You on the Platform shall be transferred to You post You making applicable payment for the same and also comply with any requirements which are applicable for the order.

6. Delivery

6.1 Delivery Timeline

We aim to deliver orders within approximately 10 minutes. However, delivery times are estimates only and not guaranteed commitments. Actual delivery may vary based on order volume, operational capacity, traffic conditions, delivery distance, weather conditions, force majeure events, and address accessibility.

6.2 Delivery Address

You must provide accurate delivery address and contact information. Failed deliveries due to incorrect information provided by you may not be eligible for refunds.

6.3 Risk Transfer

Risk of loss and title for Products passes to you upon delivery at the specified address. Please inspect Products upon delivery and report any issues immediately.

7. Cancellations, Returns, and Refunds

7.1 Order Cancellation

You may cancel orders before dispatch through the Platform interface, if available. Once an order is dispatched, cancellation may not be possible.

7.2 Refunds and Replacements

Refunds or replacements may be provided at our sole discretion for:

• Damaged or spoiled products
• Incorrect items delivered
• Missing items from your order
• Products past expiration date

Issues must be reported within 24 hours of delivery. Refund processing times may vary depending on your payment method and bank. Our refund decisions are final.

7.3 Non-Refundable Items

Certain products may not be eligible for refunds due to health, safety, or hygiene reasons. This includes but is not limited to perishable goods once accepted, personal care items, and products with broken seals.

8. User Conduct and Prohibited Activities

When using our Platform, you agree NOT to:

• Violate any applicable local, state, national, or international law
• Engage in fraudulent activities or provide false information
• Attempt to gain unauthorized access to our systems or user accounts
• Abuse promotional offers, referral programs, or discounts
• Harass, abuse, or harm our delivery personnel or support staff
• Use automated systems or bots to access the Platform
• Reverse engineer, decompile, or attempt to extract source code
• Resell or commercially exploit Products purchased through the Platform

Violation of these terms may result in immediate account suspension or termination and potential legal action.

9. Intellectual Property Rights

All content, trademarks, logos, software, and materials on the Platform are owned by or licensed to Tamilzo. This material includes, but is not limited to, the design, layout, look, appearance, trademarks, and graphics. Unauthorized use is strictly prohibited.

You are not permitted to reproduce the documents, information or materials on the Platform for the purposes of sale or the use by any third party. In particular you are not permitted to republish, upload, transmit electronically or otherwise or distribute any of the materials, documents or products that may be available for download from time to time on the Platform.

10. Limitation of Liability and Disclaimers

10.1 Service Disclaimer

THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, LOSS OF DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY OR PROPERTY DAMAGE.

10.3 Maximum Liability

Our total liability to you for any claims arising from or related to these Terms or your use of the Platform shall not exceed the amount you paid for the specific order giving rise to the claim, or INR 500, whichever is lower.

10.4 Third-Party Products

We are not responsible for the quality, safety, legality, or any other aspect of Products supplied by third-party retailers or manufacturers. Any claims regarding Products should be directed to the respective supplier.

11. Indemnification

You agree, to the extent permitted by applicable law, to indemnify, defend, and hold harmless Tamilzo, our affiliates, directors, officers, stockholders, employees, licensors, and agents from and against any and all complaints, charges, claims, damages, losses, costs, liabilities, and expenses (including attorneys' fees) due to, arising out of, or relating in any way to:

• Your access to or use of the Services or Content
• Your Content
• Your breach of these Terms
• Violation of applicable law

12. Privacy Policy

We take your privacy seriously, and encourage you to read through our Privacy Policy. By using the Platform, you consent to the collection, usage, and sharing of your information consistent with that policy. Further, by furnishing Your personal information, You consent to Tamilzo accessing Your personal information for the purpose of enabling transactions.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of courts located in [Your City], India.

14. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, government actions, or technical failures.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Platform, constitute the entire agreement between you and us regarding your use of the Platform.

17. Termination

At any time, we may revise these Terms, with or without notification, and the changes will not be retroactive. We may suspend or terminate access at any time without notice. Termination does not affect accrued rights or obligations. In the case of termination of these Terms, you continue to be bound by applicable sections of these Terms.
